MEMBERSHIPS
The Sculpt Salon may offer recurring memberships providing a specified number of EMS treatment sessions per week. The inclusions, price and frequency applicable to your membership will be displayed when you join.
All memberships have a minimum initial commitment of four weeks unless expressly stated otherwise at the time of purchase. After the initial four-week minimum term, the membership will continue on an ongoing basis until cancelled in accordance with these Terms.
Memberships are personal to the member and cannot be transferred, shared or used by another person.
MEMBERSHIP PAYMENTS
Membership payments are processed automatically through our booking and payment platform, Zenoti, using the payment method provided by the member. By joining a membership, you authorise recurring payments at the price and frequency disclosed to you when you sign up. You are responsible for maintaining a valid payment method.
If a scheduled payment fails, we may contact you and attempt to process the outstanding payment again through the payment arrangements authorised through our booking platform. Membership services may be temporarily suspended while an overdue membership payment remains outstanding, subject to applicable law.
MEMBERSHIP CANCELLATION
Memberships cannot ordinarily be cancelled during the initial four-week minimum term, except where required by law or otherwise agreed with The Sculpt Salon in appropriate circumstances.
After the minimum term, memberships may be cancelled by providing at least 7 days’ written notice. Cancellation requests must be sent by email to: contact@thesculptsalon.com.au
The membership will remain active during the applicable notice period and any payments falling due during that period remain payable. Once the cancellation takes effect, future recurring membership payments will cease.
MEMBERSHIP SESSIONS
Membership sessions are allocated according to the membership purchased. Weekly sessions must be used within the applicable membership week. Unused sessions do not roll over into subsequent weeks and will expire if they are not used within the applicable weekly period. Unused or missed membership sessions cannot be transferred to another person, exchanged for cash or credited toward another person’s treatment. This does not affect any rights or remedies available under applicable law.
MEMBERSHIP PAUSES
Eligible members may request to pause their membership for up to a maximum of four weeks. Pauses may be considered for circumstances including illness, injury, pregnancy, medical reasons, extended travel or other circumstances agreed with The Sculpt Salon.
Pause requests should be discussed with and approved by The Sculpt Salon before the requested pause period wherever reasonably possible. During an approved pause, the applicable membership billing and session allocation will be suspended for the approved period. If a membership is paused during its initial four-week minimum term, the remaining portion of the minimum term will resume when the membership is reactivated.
TREATMENT PACKAGES
Treatment packages purchased from The Sculpt Salon do not expire unless an expiry period is expressly disclosed at the time of purchase. Packages and individual package sessions are personal to the purchaser and cannot be transferred or shared with another person. Packages are not redeemable for cash. Any refund or other remedy relating to a package remains subject to your rights under the Australian Consumer Law and other applicable law.
GIFT CARDS
The Sculpt Salon may offer gift cards or gift vouchers from time to time. Gift cards will be subject to the conditions disclosed at the time of purchase and any applicable requirements under Australian law. Unless an exception under applicable law applies, purchased gift cards will have at least the minimum validity period required by Australian law.
Gift cards are generally not redeemable for cash and cannot be used after a valid expiry date, where applicable. Promotional vouchers, complimentary vouchers or discounted offers may be subject to different conditions and expiry periods where permitted by law.
TREATMENT SUITABILITY
The safety and suitability of treatment is important to us. Before receiving treatment, you may be required to complete a consultation, consent form or provide relevant information concerning your health and circumstances.
You are responsible for providing accurate and complete information relevant to treatment suitability and for informing The Sculpt Salon of any changes before subsequent treatments. The Sculpt Salon may decline, postpone, modify or discontinue a treatment where reasonably necessary for safety, where relevant information has not been provided, or where treatment is considered unsuitable.
Our services are not a substitute for medical diagnosis, treatment or advice. If you are uncertain whether EMS treatment is appropriate for you, you should seek advice from an appropriately qualified healthcare professional before proceeding.
TREATMENT EXPERIENCE & RESULTS
Individual experiences and results from EMS body sculpting vary. Factors including treatment consistency, individual physiology, lifestyle, exercise and other personal circumstances may influence a client’s experience and results.
The Sculpt Salon does not guarantee a particular physical, aesthetic or other result from treatment. Any photographs, testimonials, treatment examples or information displayed on our website or social media are provided for general informational and illustrative purposes and do not guarantee that another client will achieve the same outcome.
CLIENT CONDUCT
We are committed to providing a comfortable and respectful environment. Clients are expected to behave respectfully toward staff, contractors and other clients and to follow reasonable instructions relating to treatment and safety. The Sculpt Salon may refuse or discontinue treatment where a client’s behaviour is abusive, threatening, inappropriate or creates a reasonable safety concern.
PRICING & PAYMENTS
Prices for treatments, packages and memberships are displayed through our website, booking system or other relevant purchasing platform. Prices are in Australian dollars unless otherwise stated. Payment may be required in full or in part at the time of booking or according to the payment schedule associated with a membership or package. Any applicable recurring charges, deposits or other mandatory charges will be disclosed before purchase or booking.
REFUNDS & AUSTRALIAN CONSUMER LAW
Our cancellation, package and membership policies do not exclude or restrict rights you may have under the Australian Consumer Law. Our treatments and services come with consumer guarantees that cannot be excluded where the Australian Consumer Law applies. Where you are entitled to a refund, replacement service, cancellation or other remedy under applicable law, these Terms do not limit that entitlement.
PROMOTIONS & SPECIAL OFFERS
From time to time, The Sculpt Salon may offer promotional pricing, introductory offers, discounts or other special offers. Promotions may be subject to additional conditions, including eligibility requirements, booking periods, redemption periods or treatment limitations. Any material conditions will be disclosed with the relevant promotion.
WEBSITE USE
The information provided on The Sculpt Salon website is for general informational purposes and does not constitute medical advice. We aim to keep website information accurate and current but cannot guarantee that all information will always be complete or error-free. We may update website content, treatments, availability and pricing from time to time.
THIRD-PARTY SERVICES
The Sculpt Salon uses third-party providers, including Zenoti, for functions such as bookings, memberships, client management and payment processing. Our website may also contain links to third-party websites or services. Third-party services operate under their own terms and privacy practices.
INTELLECTUAL PROPERTY
Unless otherwise stated, content appearing on The Sculpt Salon website, including branding, text, graphics, photographs, videos, logos and design elements, is owned by or licensed to The Sculpt Salon and is protected by applicable intellectual property laws. You may view and use our website for personal, non-commercial purposes. Website content must not be reproduced, distributed, modified or commercially used without our prior permission unless permitted by law.
LIABILITY
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded or limited. To the extent permitted by law, The Sculpt Salon is not responsible for loss or damage caused by circumstances outside our reasonable control or resulting from a client’s failure to disclose information reasonably relevant to treatment suitability or to follow reasonable treatment and safety instructions.
CHANGES TO THESE TERMS
We may update these Terms & Conditions from time to time to reflect changes to our services, business practices or legal obligations. Updated Terms will be published on our website with a revised effective date.
GOVERNING LAW
These Terms & Conditions are governed by the laws of Queensland, Australia. Nothing in this section limits any rights you may have under applicable Australian consumer law.
